The notorious copyright issue with NOTLD arose because the release version of the film in 1968 failed to include proper notice and because a print of the film was never submitted to the U.S. Copyright Office for registration—both requirements for copyright protection at the time. When copyright laws were changed in 1976 to provide remedy in these situations, NOTLD did not meet the criteria for retroactive protection. The story does not end there, however. After much work, Image Ten has successfully established various intellectual property rights to the film, including a registered copyright on the 4K remastered version of NOTLD as restored by The Museum of Modern Art and The Film Foundation in 2016.
